An Illinois Appeals Court ruled that a man can pursue a claim for emotional distress after a former lover allegedly performed oral sex on him, saved the sperm, used it to have a baby, and then filed a paternity lawsuit that resulted in an award of $800 per month.

The Court said, however, that the man can’t claim theft because the sperm were hers to keep. And why were the sperm hers to keep? Well, they were hers because after the woman received ‘delivery’ of his sperm, they were “a gift - an absolute and irrevocable transfer of title to property from a donor to a donee.” This means the woman was free to do whatever she wanted with the sperm because “there was no agreement that the original deposit would be returned upon request.”

Just because I recieved a “Gift” from my wife doesnt give me the right to use it against her after we split up?? If we have 10 children together, and I leave her, Would it STILL be looked at as a gift?? No it wouldnt. It would be looked at as a burden.
I dont see how he can be liable when in fact she did this on her own thoughts and didnt include him UNTIL she wanted money. If it was million dollar sperm?? Would she have included him in splitting the money later?? I think not.. It is a clear cut case of entrapment.

I personally think, that it is emotional distress upon the man in this situation. How would any man in his right mind be able to rationalize her getting that money and crap he went thru?? I say let the broad raise the kid with NO help. She obviously didnt need his help after he blew the wad in her mouth. That woman has problems..

In fact, The judge has problems too. How can any judge say that about sperm transactions like its a car or house in a settlement suit?? Its a living breathing child, not a possession. Dumbass..

Um excuse me. If some guy is going to discharge his goods all over my body, I think I want the right to keep it, store it, make babies with it and then force him to pay child support. Who really cares if he did not do it voluntarily? Its her body, and we live in a democracy where out rights are enshrined in a constitution. And I am sure that our Founding Fathers wanted women to have the right to become the empowered citizens they are today.

By the way, I really live in Czechoslovakia, however I feel that Americans have really brought this upon themselves. Go you Illinois Judge!

And also, children are possessions — over here we call them the ultimate fashion accessory…
